The Public Utility Vehicles which are specifically BS-IV compliant and are brought before the date of 31st March can be registered and be put to use for the public.
This decision is taken so because the government had added new regulation to the vehicles that form 31st March only BS-VI can be registered and not the BS-IV because of the environmental norms and to reduce the pollution been generated by the vehicles i.e. older the vehicle, the more the pollution it will produce.
The bench was considering registration of three types of vehicles 1.CNG vehicles; 2.BS-IV Compliant vehicles; 3.BS-VI compliant vehicles which could be used for the purpose of public utility vehicles.
Further, the bench made the submission that they cannot reject the registration of the CNG vehicles because they do not produce much of the pollution and the emission of pollution is also in good limits and registration of BS-VI will be considered for the registration because the pollution released from them is in control as per now.
Also, the BS-IV diesel compliant vehicles bought by the municipal companies or the Delhi police earlier than April 1 can also be registered because it is eventually used to proved services to the public and for their welfare
The court submitted that BS-IV compliant vehicles purchased up to March 31 this yers must have been registered with the E-Vahan portal which is made by the government of India.
The bench also said that there are much application been received just for the registration of the BS-IV vehicles and further submitted and directed the EPCA (Environment pollution control authority) that. "we direct that the EPCA shall scrutiny the pending case and submit the report to the court so that the court could pass a common order and everybody who has similar concerns could check the same and act accordingly."
