Yasmeen Mansuree, an acid attack victim moved to Delhi HC seeking reservations for victims of acid attack for the post of nursing officers at AIIMS. Acid-attack victims are entitled to reservations in government appointments by the virtue of Sections 33 & 34 of the Right of Persons with Disabilities Act, 2016.
Yasmeen, along with her family had been attacked with acid in their hometown in Shamli, Uttar Pradesh 14 years ago. She subsequently completed her Diploma in General Nursing and Midwifery from Jamia Hamdard University in 2004 and registered herself with the Delhi Nursing Council. Despite having 57 percent disability, she worked as a nurse at various Delhi government hospitals. On 13th June, AIIMS had issued an advertisement inviting applications for the post of “Nursing Officer Grade B”. As per the advertisement, 32 seats had been reserved for the persons with disability. However, the kind of disability to be considered eligible for the post was limited to that of “OL-One Leg Disability” only and thus, the petitioner couldn’t apply. Subsequently, a writ petition was filed in the High Court. The counsel for the petitioner, Govind Jee argued that this constituted a violation of the provisions of the Disability Act, 2016 which recognizes acid-attack as an offense. He thus, prayed for the advertisement to be declared violative of Article 14,19(1)(g) and 21 of the Constitution of India.
The court bench comprising Justice PS Teji issued a notice to the centre and AIIMS and directed the victim to apply for the nursing post under the general category and assured her that if she thereafter succeeds in her petition, then her candidature would be considered in the Physically Handicapped category.
