Astound with heaps of pending criminal appeal before the High Court of Madhya Pradesh, Supreme Court deplored the Centre and the States for not taking appropriate measures.
These observations were made by Justice Rohinton Fali Nariman and Justice Indu Malhotra in case of Ratan Singh v. State of Madhya Pradesh where the bench has enlarged the bail of Ratan Singh whose appeal is pending before the HC of Madhya Pradesh, Indore bench and likely to take more time to be disposed of.
The bench indicated that in the previous meetings of Chief Justice of India with Chief Justices from all the states, wherein it was suggested and finally adopted by way of resolution, that ad hoc judges to be appointed within the present constitutional scheme to take care of arrears of this kind. Non-adherence to this bench lamented the Union Government and all other State Government and called it “dismal state of affairs” for not taking such measures for faster disposal of such appeals.
Bench further commented that “Citizens of India have to face enormous hardship and many persons are languishing in jails.” Bench in pursuance to it further asked for the accountability from the state regarding such measures;“We wish to know what steps have been taken in this regard by the Union of India as well as all the other States. Issue notice to all the other States.”
“It cannot be gainsaid that it is extremely important that criminal appeals that are pending in the High Courts all over the country be disposed of at once without further delay.”
Court also directed the Union as well as State government to give Supreme Court an action plan within a period of eight weeks from the date of this order on affidavit, stating exactly how they intend to create the necessary infrastructure so that ad-hoc Judges be appointed to dispose of these matters.
