The bench comprising of Justice Rohinton Fali Nariman and Justice Indu Malhotra observed that large number of criminal appeals are pending in the High Court. To this the SC criticised the State and the Centre for not complying with the resolution adopted by the Chief Justice T.S. Thakur and Chief Justices of other HC to appoint ad- hoc judges. The notice was issued to all other States to receive the information about the steps taken by them regarding the resolution.
The whole observations were made while enlarging the petitioner on bail as he had been in jail for almost 6 years and the appeal which is pending in the HC of Madhya Pradesh will take more time for the disposal.
The bench also pointed out the huge pendency of criminal appeals and referred it as a “dismissal state of affairs”. It also referred that State of Madhya Pradesh is hearing criminal appeals of the year 2001 and 2002. Due to which citizens are facing many hardships.
The Court further directed the Centre and the States to present an action plan within 8 weeks regarding the necessary infrastructure for appointments and functioning of ad- hoc judges. The next date of hearing was fixed on 18th September.
