Karkardooma court granted bail to a man accused in the Delhi riots case. The court observed that 'the investigation in the case against him left a lot to be desired’. The single Judge Amitabh Rawat of the additional sessions court was hearing a plea against the accused named Ajay who was charged under sections Section 147/148/149/427 of the Indian penal code.
The arguments put forth by the counsel for the defendant was that he was a student of class 11th and was the sole bread earner for the house. His father was a heart patient and in a very serious condition and his mother was also bedridden and thus both the parents were dependent on him and his earnings. The only source of income for the family was the young 11th-grade boy who earned by taking tuitions in nearby areas while managing his school at the same time. Thus, being the sole earner of the house and being the only hope for his parents he needed to take care of them. Further, there was no other family member to provide support. It was also submitted that during the riots various first information reports were registered in distinct areas and thus the accused was falsely implicated among other people. Despite having no evidence nor any CCTV footage against the accused he is in jail for the last five months which is not ethically right.
The complaint against the accused was reported by an anonymous person who claimed that he was involved in the burning of his house. But the court rightly held in this situation that the complainant is not an eye witness. As per the “witnesses” claims the accused was arrested by a nearby police station. The court further noted, There is a statement of the witness Md. Aslam recorded on 18.04.2020, as per which, two accused persons namely Ajay and Gaurav were arrested at his instance whereas the look at the arrest memo of the said accused Ajay shows Md. Aslam is one of the witnesses but the place of arrest is not a public place but Police Station Jyoti Nagar itself. The investigation in the present case leaves a lot to be desired."
