The Supreme Court, in an oddly appropriate judgement against Goel Ganga Developers Pvt. Ltd. fined the latter for environmental violations, while allowing the illegal construction performed by them to endure.
In response to a complaint filed by Tanaji Balasahed Gambhire, the National Green Tribunal closely examined the ongoing construction being performed by GG Developers and rendered the complaint to be accurate. The Complaint claimed that the ongoing project was in violation of numerous environmental clearance laws, as well as municipal laws.
In a frenzy of back and forth litigation that occurred between the NGT, GG developers, as well as Pune Municipal Officers who were duty bound to not approve the initiation of the illicit construction, the appeals found their way to the apex court.
The presiding Judges, Justice Madan B. Lokur and Justice Deepak Gupta, upheld the original assessment by the NGT that the construction in question did in fact, overstep the boundaries of the actual environmental clearance granted to it.
Ultimately, The Supreme Court ordered the Developers to pay a fine of Rs. 100 crores, or 10% of the total cost of the project, whichever may be higher. In addition to this, another fine amounting to Rs. 5 crores was owed to the NGT. Regarding the ongoing construction, the bench decided to halt any further additions to the complexes already made, and decreed against the demolition of the existing illegal structures. The justification being the potential losses which would be incurred by the uninvolved third parties who had prior vested interest in the finished project.
