The conflict between private educational institutions and parents of the students is not a new one. The most recent case being the one between the administration of Sri Sri Ravi Shankar Vidya Mandir and the parents was ignited by a sudden surge in the fees demanded by the CBSE affiliated school. The predicament escalated when the parents of some students adopted an uncalled-for form of protest, and the school wrongfully retaliated by harshly expelling the children of the protesting parents.
Unfortunately, the school did not stop there. The situation took an ugly turn when the school decided to withhold the marksheets and certificates of the newly expelled students. This regrettable step invigorated the parents into seeking legal action against the school. The complaint first landed at the doorstep of the Kerela State commission for child rights, then the state government for enquiry and then the district collector, who demanded the school return the documents that belonged to the students. On receiving the direction from the DC, the school decided to deploy legal measures, and thus, the complaint ultimately reached the High Court of Kerela, where this particular matter was scrutinized by the hon’ble Justice A. Muhammed Mustaque.
The presiding Judge mourned the unnecessarily aggravating steps taken by both the parties, and observed that the primary drive of both the parties was monetary. The court sought to get to the root of the problem, and devised that the conflict arose due to the absence of an official channel which addressed the grievances of the parents regarding fee hikes. In his introspective judgement, the judge observed that the fight between the staff and guardians should not affect the tender mentalities of the students. The state concluded that any institution who charges fees which is disproportionate with the services provided, is looking to profit from the field of education, and such an institution is subject to amendments from the state.
Finally, The students were re admitted, and the parents were let off with a warning.
