In the case of A. Thirupathy v. The District Collector, Madurai District the Madras High Court on Friday has directed the administration to allow the conduct of the Kanuparivettai Festival. The court has said that since the government has allowed 100 percent occupancy in theatres and also permitted the conduct of Jallikattu, the Kanuparivettai festival should also be permitted.
The petition was brought before the court under the apprehension that the conduct of the festival by the trustees of the Sri Melaramanuja Kooda Dharma Paribalana Sabai, who conducts the festival every year, would not be permitted this year due to the ongoing pandemic. It was submitted by the petitioners that they would adhere to all the safety norms and guidelines given by the local administration.
The court in reply directed the respondents to permit the conduct of the Kanuparivettai festival. “When the Government has permitted the theatres to open with 100 percent occupancy and Jallikattu is to be conducted, there is no reason to deny permission to the petitioner to conduct (Kanuparivettai Festival)” remarked Justice G. R. Swaminathan.
What is interesting to note is that the court has directed that only 50 percent occupancy is allowed till 11th January 2021 on Friday itself. This order was given in response to the petitions filed before the court challenging the order of the government to allow for 100 percent occupancy in theatres.
“There couldn't be any permission to run the Multiplexes and Cinema Theatres over and above 50 % of the seating capacity, in the State of Tamil Nadu, till 11.01.2021, as the pandemic does not respect time,” the court said.
The order for reducing the seating occupancy in the theatres was given by a Division Bench of Justices M.M. Sundresh and S. Ananthi.
