The review petitions filed against the verdict of the Supreme Court upholding the Aadhar Project are listed for tomorrow before a five-judge bench. The five-judge bench comprises of Justices AM Khanwilkar, DY Chandrachud, Ashok Bhushan, S Abdul Nazeer, and BR Gavai will hear the petitions at 1:30 pm on 11th January.
Justices Khanwilkar, Chandrachud, and Ashok Bhushan were also a part of the original bench which had decided the case in September 2018. The judgment was passed with a 4:1 majority, wherein Justice Chandrachud was the lone dissenter. The majority had upheld the Aadhar scheme but had struck down certain provisions of the Aadhar Act, 2016. Justice DY Chandrachud in his dissent had held that to consider the Aadhar Act as a money bill will be a fraud on the constitution. He also observed that the entire Act was unconstitutional and that it was terrifying that there are valid concerns about the infringement of citizens' privacy.
An ethical hacker Elliot Alderson took on Twitter to inform the Government of India that Aadhar has a lot of concerning problems and the government is putting the data of their citizens at risk. Aadhar has a lot of privacy issues. Nearly two years ago, in a Twitter incident, former Unique Identification Authority of India (UIDAI) Director-General and current TRAI chairman Ram Sewak Sharma had shared their aadhar numbers on Twitter and challenged the hackers to harm their personal data in wake of proving the governments' argument that aadhar is safe. Accepting the challenge, several hackers replies with his personal information, phone number, email id, PAN number, etc. The Hackers also deposited 1 rupee in his bank account, showing that they can even get their bank account details with the help of Aadhar number. However, the government after humiliation on social media still stood by their point that no data has been fetched and the Aadhaar database is safe.
