A Public Interest Litigation has been filed in the Delhi High Court for obtaining directions from the Department of Education, Government of NCT of Delhi, to exempt admissions in Nursery Education in schools for the 2021-22 session (Rajat Vats v. Government of NCT of Delhi, Department of Education). The PIL has been filed because it is felt that the purpose of Nursery Education cannot be fulfilled by way of Online classes. Due to the ongoing Covid-19 pandemic and countrywide lockdown, classes for all schools and colleges in the country are being conducted through online mode.
The petition has been filed by Mr. Rajat Vats. According to the petition filed, a schooling behavior is developed by nursery education as it stabilizes their emotional as well as physical well-being in their growth years, making them ready to get promoted to higher classes. According to the petitioner, this is done through the playschool environment that is made for kids. However, this kind of environment cannot be developed through online classes, the petition states.
The petition also takes the ground of Article 14 and 21 of the Constitution of India. It says that in allowing these admissions and teaching kids in the age group of 3-4 years through online classes, it is violating the rights given by the Constitution to parents and children under articles 14 and 21.
Earlier in 2020, the petitioner had approached the Delhi HC to provide relaxation in fees charged for the facilities provided by private schools in NCT of Delhi, except tuition fee, due to the Covid-19 pandemic. However, the said petition was dismissed by a single judge bench comprising Justice Pratibha M Singh on 20th April 2020.
