Justice Madan B. Lokur stated at a webinar on Keys to Governance: Independence of Judiciary organised by the India International Centre and DS Borker Memorial foundation that there should be no criminal contempt of court. “Judges should not be hyper-sensitive about everything. If the criticism is constructive, then it is fine. Even if it is not, forget about it! There are so many things in life!” The former supreme court judge was heard saying this when asked whether Contempt of Court Act should be relaxed.
In this webinar, the judge was also asked about post-retirement benefits. He stated that it depended on each judge. He talked about how reporting was being done on the events that are happening in Washington DC. One speaker had talked about how Trump had lost all cases despite being heard by Republican judges. In India, judges do not align with a political party. If the judge had integrity, his political alignment does not matter. This is the same for post-retirement benefits as well. If a judge does not have integrity, he will be swayed by political considerations. He also stated this was the same for posts other than judges. He also agreed that the judiciary had put 2019 and 2020 away and wished not to dwell in the past but to look forward. “We must look at the future as to what can the Judiciary do in 2021 to regain the prestige, which has been lost in part, and most importantly to deliver justice to the people of India” He also felt that having a Public Relationship Officer or a spokesperson appointed to the court would help the Supreme Court when the discussion was brought up. A PRO would make the Supreme Court more accessible and help the judiciary become far more transparent.
