The sad state of animal welfare implementation by the government was brought to light when a PIL was filed by a animal rights NGO, People For Animal, Manipur. Violations regarding the Prevention of Cruelty to Animals Act were brought to the attention of the Court.
The head of the bench of presiding judges, Chief Justice Ramlingam Sudhakar examined the affidavits submitted by the state with regards to the matter and it was concluded by them that the Animal welfare board is non-functional and the Societies for Prevention of Cruelty to Animals is still a body that only exists on paper even though it should have been established by 2012. The bench pleaded to the SC in its judgement as they mentioned that this matter was a violation of “Right to Life” itself and further explained how it is the duty of the state government to not only protect the rights of these animals but also honour them.
The order of the Supreme Court passed regarding the Animal Welfare Board India case, the Supreme Court requested all the High Courts to not pass any order regarding the Act and/or even the Rules. The PIL that was with accordance to dogs and other domestic animals was disposed. The State governments were ordered to implement the laws of animal welfare and send a report for the same within four months.
