The Division Bench, comprising of Justice Siddharth Mridul and Justice Talwant Singh, of the Delhi High Court, on Monday 18th January heard the matter of Court on Its Motion v. Government of NCT of Delhi and Anr (W.P.(C) 3080/2020).
The Court ordered for an extension to the interim relief granted in the form of bail to 3499 people, who were currently undertrial, for an additional period of 30 days. The Court stated that the interim bail granted to those currently undertrial will be extended by 30 days from their respective date of expiry of the bail period. The Court further elucidated that the terms and conditions of the interim bail will remain the same as before the extension.
The Court has also directed the Director General (Prisons) to make sure that all those who will be benefitting from this order are informed of the same through use of various mode of communications such as phone calls and all other modes of communication available to them.
The basis of this judgement are the recommendations made by the High Powered Committee and dated 28th March 2020, 7th April 2020, 18th April 2020, 5th May 2020, 18th May 2020, 20th June 2020, 31st July 2020, 30th August 2020, 24th October 2020 and 28th November 2020. The Court also relied on the judgement delivered in Shobha Gupta and Ors. v. Union of India and Ors. (W.P.(C) 2945/2020) by the Division Bench, comprising Justice Hima Kohli and Justice Subramonium Prasad, of the Delhi High Court.
A Committee had been formed as per the orders issued by the Supreme Court of India, in Suo Moto Petition (Civil) No.1/2020- in Re; Contagion of COVID-19 Virus in Prisons, dated 23rd March 2020 and 13th April 2020. The objective of this committee was to decongest the jails in order to prevent the spread of COVID - 19 in jails.
The matter has also been listed for 18th February to be further considered.
