On Monday, A three-judge bench of the Supreme Court dismissed a petition that was in pursuit of getting directions to make certain of free and fair elections in the forthcoming elections for the West Bengal assembly, citing that the petitioner was not from the state of West Bengal and hence faces no violation of her fundamental rights.
Puneet Kaur Dhanda, an advocate from Delhi, the petitioner purported that the election to be held in West Bengal would be forged with fake votes, targeting of opposition leaders and Muslim votes and thereby plead for the implementation of parliamentary forces in the state to help ot for free and fair elections.
"It’s Article 32 plea. Your fundamental rights are not violated. The petitioner is not even from West Bengal," said Justice Ashok Bhushan who was heading the Bench.
The PIL had special emphasis on the issues of killings of BJP leaders in the state and also called on the Ministry of Home Affairs to produce a detailed action taken report linked to the investigation of the alleged killings emphasized before. The petition prayed for protection to be granted to all opposition leaders in the state.
The petitioner also sought direction from the Election Commission for submitting a thorough report about the bogus voters and ensure consecutive steps necessary for their removal be taken.
Advocate Vineet Dhanda has emphasized the fact that Muslims would play a vital role in the West Bengal Elections that would eventually lead to a methodical target of the BJP leaders. The presence of registered voters from Telangana in Bengal, leads to fake votes, further destruction from the free and fair elections.
The bench of this petition included Justice Hemant Gupta and R. Subhash Reddy failed to accept the terms of the petition and dismissed it.
