For the close follow up and monitoring of the National Register of Citizens (NRC), the Supreme Court has ordered the State Coordinator, Prateek Hajela to make the copies of final draft of NRC available in all Panchayat offices and all other places to make the draft of NRC easily available. The coordinator was further directed to file the percentage of population in the court, in a sealed cover who had been left out of the NRC final draft. The order was passed by a bench headed by Justice Ranjan Gogoi and Justice Nariman. Additional Solicitor Tushar Mehta further said that for better convenience, the copies of draft NRC should be handed over to Panchayat offices at villages and all the deputy commissioners’ offices.
The Court, before passing the order took need of several stakeholders to be as just as possible. The stakeholders include All Assam Students Union (AASU), All Assam Students Minority Union (AASMU), Jamiat Ulema-i-Hind, Assam Public Works, Assam Sanmilita Mahasangha, National Democratic Front of Bodoland (Progressive), Indigenous Tribal Peoples Federation, All Assam Bhojpuri Parishad and the Joint Action Committee for Bengali Refugees. Apart from this, the Court also sought view on the Standard Operating Procedures to understand the mode of filing and disposal of claims, together with objections pertaining to the National Register of Citizens. The Bench however did not lean on the views of any political party to derive greater transparency.
It was on July 31st when the Bench had observed that NRC had only made a draft for the State of Assam and therefore no action can be taken based on this. This order was however a much needed move on the part of the judiciary especially given the turmoil in Assam about the exclusion of over forty lakh persons from the final draft list. Without commenting on any of the modalities suggested on behalf of the Union of India in close consultation with the Government of Assam, Registrar General of India and State Coordinator for NRC, the Court decided to give the stakeholders time until 25th August, 2018 to get their views. The receipt of the claims and objections is thirty days and must be received on August 30.
