The second bail plea of Sadaqat Khan, the co-accused in the Munawar Faruqui case was rejected by the District and Sessions Court, Indore. Khan had applied for a bail plea for the second time with the aid of his advocate Suresh Kumar Verma on the basis of 'parity' as Munawar Faruqui was granted interim bail by the Supreme Court a few days ago. The Additional Sessions Judge Yatindra Kumar Guru opined that there had been no changes in the circumstances since the rejection of his first bail application which was filed by Advocate Nasir Mohd. Khan and if his second bail plea is allowed, it would amount to a review of the previous rejection which is not permitted under the criminal laws. Moreover, Sadaqat had applied for a regular bail plea, therefore the benefit of parity was not applicable in his case as Munawar's plea was interim and was granted by the apex court.
Sadaqat Khan's bail plea was also opposed by the Tukoganj Police while accusing Khan of organizing events that were similar to the present case and a handful of complaints had been previously filed against him in Maharashtra and Uttar Pradesh. The police stated that Khan's phone contained a video clip of Faruqui's show and expressed its concern regarding law and order issues in case his bail was accepted.
Sadaqat was arrested along with Munawar Faruqui, Prakhar Vyas, Priyam Vyas, Nalin Yadav, and Edwin Anthony on a complaint by Eklavya Singh Gaur, son of a local BJP legislator Malini Laxman Singh Gaur, and was charged under Section 34, 188, 269, 295A, and 298 of the Indian Penal Code of 1860 for making indecent remarks on Hindu Gods and Union Home Minister Amit Shah.
The court cited the case of Satpal Singh v. the State of Punjab and Rukmani v. the State of Jharkhand while rejecting the bail application.
