Justice R. Regupathi on August 20, 2018 has submitted his resignation while objecting to the suspension of the Inquiry Commission headed by him. The Inquiry Commission was given the task of checking the irregularities in the construction of Secretariat complex in Omandurar during the regime of Dravida Munnetra Kazhagam (DMK) party. Justice Regupathi was made the head in 2012 after the resignation of Justice S Thangaraj. The Madras High Court while suspending the Inquiry Commission observed that the funds being spent for the purposes of Commission were waste and unnecessary.
Justice Regupathi objected to the unwarranted oral remarks because as shown, the work of the Commission was stopped primarily because of the administrative delay.
The Madras High Court directed the Commission not to take any further actions., since many petitions were filed. It was difficult for him to get his case listed and thus he pointed out this as the major obstacle. Plea for early hearing was even rejected. Several petitions which were filed by the Commission to vacate the stay order but they were not listed. Justice Regupathi further pointed out that the order was passed without any logic and there was administrative lethargy on the part of Court Registry which ought to have been noticed by the Court. More than three years had been taken by the High Court not for disposal but for the listing of case. He also argued that the remarks which have been made have damaged the reputation of the Inquiry Commission and passing such comments against the Retired Judges is highly wide of the mark.
