Road accidents are the major cause of loss of lives of thousands of citizens. 90% of the accidents are caused due to the rash or negligent driving or even driving in drunken state. India has a high record of road accidents and the ignorant attitude of the drivers needs to be curbed.
Besides, the condition of roads in India one major cause of accidents is not having strict laws for the punishment of those driving negligently.
Section 304A of Indian Penal Code, 1860 states that the punishment for rash and negligent driving is two years in addition to the monetary compensation. The bench said that only much stricter punishment will serve the purpose and will help in curbing the volume of accidents.
The Court observed and said that the law makers should analyze the law and re-consider Section 304A of IPC and deterrent punishment should be adopted. The attitude of the people projecting themselves as ‘larger than life’ puts the poor people in a constant fear of death. Even the pedestrians and civilized persons drive in constant fear.
The Court said that it has been taking notice of the fact of increase in accidents. The adventurous attitude of today’s youth and behaving as if there are no traffic rules needs to be controlled. Further, the Bench observed that many people believe that harsh punishment can be avoided by paying compensation. It is important to realize that the lives of people are above anything else. One must not be forced to live under a constant fear of death.
