One Asif Riaz submitted a plea in the Madras High Court seeking damages of INR 5 crore damages from the Serum Institute of India. The Chennai-based business consultant claimed that he suffered severe adverse reactions including acute neurological encephalopathy and had to be hospitalized after receiving a dose of COVIDSHIELD which is a vaccine produced by the SII to protect against COVID-19. He had received the dose back in October of last year. He also claimed that no one from the Serum of Institute of India or other concerned authorities called him to examine the side effects and threatened to file an INR 100 crore defamation case against him instead for 'sharing his experience with the general public'.
The petitioner said that a few days after getting vaccinated he woke up with a severe headache that remained for the whole day, after which he decided to consult a doctor. The doctor advised him to undergo an MRI and a CT scan and suggested that the symptoms might be a result of the vaccination. On the day he went to the hospital where the vaccination had been administered he vomited and had trouble recognizing faces and felt physically weak.
He also raised an objection against the findings given by the expert committee set up by the Drug Controller of India which concluded that the adverse reactions were not a result of the dose of the vaccine. The petitioner further complained that he was not given an opportunity to defend his position and came across the development through a newspaper report.
The petitioner requested the court to direct the SII to pay damages to him for the trauma and suffering experienced by him and his family under Rule 2(ff) and sub-rule (a), Rule 41 the New Drugs and Clinical Trial Rules of 2019. The petitioner stated that the vaccine is not safe for everyone.
