In an interesting case the State of Haryana, the appellant appealed to the Supreme Court to grant a stay order on Criminal Proceedings against the accused. The accused are the directors of a company charged with the stampede of seven workers followed by a blast in the factory. In 2006, the Punjab and Haryana High Courts entertainment the plea of the accused and charged them with murder case under section 304-A of IPC.
The State has appealed to the Supreme Court challenging this conversion. The Apex Court had always adjourned the case for one reason or another while initially granting an ad interim stay when the Special Leave Petition was moved. The bench on Monday was being led by Justice Ajay Manohar Sapre and Justice Sanjay Kishan Kaul who found no merit in the appeal. The bench did not find any fault in the Judgment of the high court for altering the charges from section 302 to section 204 A of IPC. The bench directed the trial court to follow the directions of the High Court for deciding whether any charges under section 304-A of IPC has been made against the accused.
The bench felt sorry of the fact that due to the pendency of litigation, the trial has remained stayed for all these years.
