All the acquittals in a criminal case has to be taken seriously by the prosecuting and investigating authorities. This was observed by the Supreme Court Bench headed by Justice NV Ramana and Justice Mohan M Shantanagaudar. The case in question pertained to a panchayat elections crime where the supporters of the losing candidate were accused of killing their own election agent and later blame the son of the winning candidate for having done so. The high court upheld the conviction order of the trial court and dismissed the appeal later.
The bench observed that motive had an important role to play as this case rested a lot on circumstantial evidence. Even if motive was taken into account this would only prove one of the circumstances for adducing the guilt o the accused. The bench further said that the wife did not have much confidence to the case as there was a former enmity with the accused. There are long gaps in the prosecution story and areas insufficiently proved. The court while acquitting the accused said that lack of disciplines investigation has failed to render a finality to the case. Due to lack of evidence that is concrete in nature , the acquittal has to be implemented. However a blind eye cannot be turned to the investigative deficiencies.
