TAMIL NADU PAYMENT OF SALARIES (AMENDMENT) ACT, 2008

An Act further to amend the Tamil Nadu Payment of Salaries Act, 1951.
 
Be it enacted by the Legislative Assembly of the State of Tamil Nadu in the Fifty-ninth Year of the Republic of India as follows:—
 
1.Short title and commencement.—(1) This Act may be called the Tamil Nadu Payment of Salaries (Amendment) Act, 2008
 
(2) It shall be deemed to have come into force on the 1st day of October 2007.
 
2.Amendment of Section 12-B.— In Section 12-B of the Tamil Nadu Payment of Salaries Act, 1951 (Tamil Nadu Act XX of 1951), after sub-section (2-C) the following sub-sections shall be inserted, namely:-
 
‘(2-CC) (i) Where, before the 15th day of November 1996, any Member of the Legislative Assembly died before the expiry of term of his office;
 
(ii) Where, on or before the 31st day of October 1986, any Member of the Legislative Council died before the expiry of the term of his office;
 
the family of such member shall be entitled to receive a family pension of rupees three thousand and five hundred per mensem.
 

Explanation.- For the purposes of this sub-section, the word ‘family’ shall have the same meaning assigned to it in sub-section (2-B)
