THE UTTARANCHAL COMMISSION FOR MINORITIES (SECOND AMENDMENT) ACT, 2003

PREAMBLE
An Act to further amend the Uttaranchal Commission for Minorities Act, 2002
Be it enacted in the Fifty-fourth Year of the Republic of India as follows:--
Section 1 - Short title, extent and commencement
(1) This Act may be called the Uttaranchal Commission for Minorities (Second Amendment) Act, 2003.
(2) It extends to the whole of Uttaranchal.
(3) It shall come into force with immediate effect.
Section 2 - Amendment of clause (c) of Section 2 of the principal Act
Clause (c) of Section 2 of the principal Act shall be amended as follows:--
The words "and Vice-Chairman" shall be added after the word "Chairman".
Section 3 - Substitution of sub-section (2) of Section 3 of the principal Act
Sub-section (2) of Section 3 of the principal Act shall be substituted as follows:--
"The Commission shall consist of a Chairman, a Vice-Chairman and nine members nominated by the Government from amongst persons of eminence, ability and integrity including a woman, provided that the Chairman, Vice-Chairman and members shall be from amongst the minority communities.".
Section 4 - Amendment of Sections 4, 6, 14, 16 and 17 of the principal Act
Wherever the words "Chairman and Members" occur in Sections 4, 6, 14, 16 and 17 of the principal Act, shall be read as "Chairman, Vice-Chairman and Members".
Section 5 - Addition of two new sub-sections (4) and (5) after sub-sections (3) of Section 8 of the principal Act
After sub-section (3) of Section 8 of the principal Act, two new sub-sections (4) and (5) shall be added as follows:--
"(4) If the office of the Chairman becomes vacant or if the Chairman is, for any reason, absent or unable to discharge the duties of his office, these duties shall, until the new Chairman assumes office or the existing Chairman resumes his office, as the case may be, be discharged by the Vice-Chairman.
(5) If the offices of both Chairman and Vice-Chairman become vacant, the duties of the office of Chairman shall be discharged by such member, as the State Government may, by order, direct.".
