An Act to amend the Code of Criminal Procedure, 1898, in its application to West Bengal. WHEREAS it is expedient to amend the Code of Criminal Procedure, 1898, in its application to West Bengal for the purpose and in the manner hereinafter appearing; It is hereby enacted as follows:
Section 1 Short title
This Act may be called the Code of Criminal Procedure (West Bengal Amendment) Act, 1972.
Section 2 Application of the Act
The Code of Criminal Procedure, 1898 (hereinafter referred to as the said Act), shall, in its application to West Bengal, be amended for the purpose and in the manner hereinafter pro- vided.
Section 3 Amendment of section 251A of Act 5 of 1898
In section 251A of the said Act, in sub-section (6), after the word "witnesses", the following words shall be added, namely : "and shall summon the witnesses and call for the documents or things, specified in any application made on behalf of the prosecution unless, for reasons to be recorded, he deems it unnecessary to summon or call for all or any of them.".
