LEGISLATIVE ASSEMBLY OF MEGHALAYA (MEMBERS' PENSION) AMENDMENT BILL, 1995
A Bill Further to amend the Legislative Assembly of Meghalaya (Members' Pension) Act, 1977. Be it enacted by the Legislature of the State of Meghalaya in Forty-Sixty Year of the Republic of India as follows :-
Short title and application
1. (1) This Act may be called the Legislative Assembly of Meghalaya (Members' Pension) Amendment Act, 1995.
(2) It shall apply in relation to pension due for the period commencing on the first day of December, 1995.
Amendment of section 3 of Act 6 of 1977.
2. In section 3 of the Legislative Assembly of Meghalaya (Members' Pension) Act, 1977, as amended -
(i) for the words 'one thousand' occurring in sub-section (1) and for the words 'one hundred and 'two thousand' occurring in the second proviso thereto, the words two thousand', 'two hundred' and 'five thousand' shall respectively be substituted.
(ii) for the words 'Chief Minister', Minister or Minister of State or as the Speaker or the deputy Speaker' occurring in sub-section (2), the words 'Leader of the Opposition, Parliamentary Secretary, Minister or Speaker shall be substituted.
(iii) below sub-section (2), the following explanation shall be added, namely -
"Explanation - The term 'Minister' includes the Chief Minister, Deputy Chief Minister, Minister of State and a Deputy Minister and the term 'Speaker' includes the Deputy Speaker'.
STATEMENT OF OBJECTS AND REASONS
1. The existing pension of the Ex-MLAs of the Meghalaya Legislative Assembly which was last revised in 1992 is not adequate when compared to the increasing cost of living. It is therefore felt that the pension be increased by further amending the Legislative Assembly of Meghalaya (Members' Pension) Act, 1977.
2. Some consequential changes in sub-section (2) of section 3 of Act is also considered necessary to bring in the Deputy Chief Minister, Deputy Ministers, Parliamentary Secretaries and the Leader of the Opposition within the purview of the Act.
Hence the Bill.
FINANCIAL MEMORANDUM
The Bill when enacted will involve additional expenditure from the Consolidated Fund of the State of Meghalaya, Subject to the actual number of person who will be drawing pension at any point of time, the additional expenditure will be about rupees twenty lakhs annually.
EXTRACT OF RELEVANT SECTIONS OF ACT 6 OF 1977
Pension payable to members
3. (1) With effect from the commencement of this Act, there shall be paid a pension of one thousand rupees per mensem to every person who served for a period of not less than five years whether continuous or not, as a member of the Legislative Assembly.
Provided that in the event of early holding of elections where any person has served as such member for a period falling short of five years he shall not be deemed to have served for a complete period of five years if such period falls short by not more than three months:-
Provided, further, that even when any person has served as a member of the Legislative Assembly for a period exceeding five years there shall be paid to him an additional pension of rupees one hundred per mensem for every year in excess of the five, however that in no case shall the total pension payable exceed rupees two thousand per mensem.
(2) In computing the number of years for the purposes of sub-section (1), the period during which a person has served as Chief Minister, Minister or Minister of State or as the Speaker or Deputy Speaker of the Legislative Assembly, shall be taken into account.
