TAMIL NADU AGRICULTURISTS RELIEF (AMENDMENT) ACT, 1948

[THE (These words were substituted for the word “Madras” by the Tamil Nadu Adaptation of Laws Order, 1969, as amended by the Tamil Nadu Adaptation of Laws (Second Amendment) Order, 1969) [TAMIL NADU AGRICULTURISTS RELIEF (AMENDMENT) ACT, 1948.]

An Act further to amend this Tamil Nadu Agriculturists Relief Act, 1938.

WHEREAS it is expedient further to amend the (These words were substituted for the word “Madras” by the Tamil Nadu Adaptation of Laws Order, 1969, as amended by the Tamil Nadu Adaptation of Laws (Second Amendment) Order, 1969) [Tamil Nadu] Agriculturists Relief Act, 1938, for the purposes hereinafter appearing; It is hereby enacted as follows:—

Short title

1. This Act may be called the (These words were substituted for the word “Madras” by the Tamil Nadu Adaptation of Laws Order, 1969, as amended by the Tamil Nadu Adaptation of Laws (Second Amendment) Order, 1969) [Tamil Nadu] Agriculturists Relief (Amendment) Act, 1948.

(Sections 2 to 15 were repealed by Tamil Nadu act XI of 1952) [2-15. * * * *]

Amendments to have retrospective effect in certain cases

16. The amendments made by this Act shall apply to the following suits and proceedings namely:—

(i) all suits and proceedings instituted after the commencement of this Act;

(ii) all suits and proceedings instituted before the commencement of this Act, in which no decree or order has been passed, or in which the decree or order passed has not become final, before such commencement;

(iii) all suits and proceedings in which the decree or order passed has not been executed or satisfied in full before the commencement of this Act:

Provided that no creditor shall be required to refund any sum which has been paid to or realized by him, before the commencement of this Act.
