TAMIL NADU CATERING ESTABLISHMENTS (AMENDMENT) ACT, 2000

Act No. 43 of 2000

 

An act further to amend the Tamil Nadu Catering Establishments Act, 1958.

Be it enacted by the Legislative Assembly of the State of Tamil Nadu in the Fifty-first Year of the Republic of India as follows:-

1. Short title and commencement.

(1) This Act may be called the Tamil Nadu Catering Establishments (Amendment) Act, 2000.

(2) It shall come into force on such date as the State Government may, by notification appoint.

2. Insertion of new section 23-A.

After section 23 of the Tamil Nadu Catering Establishment Act,1958 the following section shall be Inserted, namely:-

"23-A. Compounding of offences.- (1) Any offence punishable under sub-sections (1), (2-A) and (3) of section 23 may, either before or after the institution of the prosecution, be compounded by the Commissioner of Labour or such other officer as may be authorised in this behalf by the Commissioner of Labour, on payment, for credit to the State Government, of such sum as the Commissioner of Labour or such other officer may specify:

Provided that such sum shall not, in any case, exceed the maximum amount of fine which may be imposed under this Act for the offence so compounded.

(2) Sub-section (1) shall apply for the first and any subsequent offence.

(3) Where an offence has been compounded under sub-section (1) no proceeding or further proceeding, as the case may be, shall be taken against the offender, in request of the offence so compounded and the offender, if in custody, shall be discharged forthwith.

(4) No offence punishable under this Act shall be compounded except as provided by this section.
