Subject : My brother's wife moved to her maternal home along with all jewelry,clothes and with 6 years old girl child.my brother is planning to divorce her due to her quarreling nature.
Question : After divorce,who will get the custody of girl child ?my brother or her wife?
Answer by Seema Sirsat : The mother usually gets custody of the minor child, girl child but it is not a strict rule and is primarily decided based on the child’s interests.
The choice of a child above the age of nine is considered.
A mother who is proven to neglect or ill-treat the child is not given custody. Hence you have to prove that your brother's wife is not capable and she is negligent towards her child.
