AGREEMENT FOR CONSTRUCTION OF INCOMPLETE FLAT BY THE VENDOR ON BEHALF OF THE PURCHASER

BETWEEN
_____________ s/o _________________, by religion ______________ by occupation _______________ and ____________________ w/o __________________, by religion ______________, by occupation ___________________, both residing at ___________ hereinafter Jointly referred to as “the OWNERS” (which term or expression shall unless excluded by or repugnant to the context be deemed to include their respective heirs, executors, administrators, legal representatives and assigns) of the ONE PART
AND
_____________ s/o _________________, by religion ______________ by occupation _______________ (hereinafter referred to as “the CONTRACTOR”) (which term or expression shall unless excluded by or repugnant to the context be deemed to include his heirs, executors, administrators, legal representatives and assigns) of the OTHER PART:
WHEREAS by an Indenture of Conveyance dated _______, made between the Contractor herein, therein described as “the Vendor” of the One Part and the Owners herein, therein described as “the Purchasers” of the Other Part, for the consideration mentioned therein, and registered in the Office of the Registrar of Assurance at ________ In Book No. ___ as Deed No. _____ for the year ______ the Vendor therein granted sold conveyed assigned assured and transferred to and unto and in favour of the Owners herein one partly built and unfinished one- storeyed brick-built building comprised in and known as_______ within the ________ Municipal Corporation as fully described in the Schedule written thereunder.
AND WHEREAS the Owners have purchased the said property with the clear understanding that after sale of the said property the Vendor shall undertake the entire responsibility of completion of the construction of the incomplete-and unfinished work in the building comprised in the said property at the cost of the owners.
AND WHEREAS the Vendor being the Contractor herein has agreed to undertake the construction of the said work under the terms and conditions hereinafter appearing.
NOW THIS AGREEMENT WITNESSETH as follows:
- The contractor shall execute, maintain and do the several works and things mentioned and described in the Schedule or Specification annexed hereto and signed by the Contractor and also by the Owners in accordance with the sanctioned Building Plans, drawings and specifications referred to in the Schedule in and upon the premises referred to herein within the time or times and in consideration of the payments to be made to her by the Owners as therein mentioned, and shall in all respects be bound by, perform, observe and fulfil all the conditions, stipulations and provisions therein contained and which are expressed or intended to be binding on and to be performed, observed or fulfilled by the contractor.
- In consideration of the premises the Owners shall make to the contractor the payments mentioned in the said Specification or particular at the respective times and in the manner therein mentioned, subject to the deductions, retentions and abatements (if any), to be made therefrom is therein expressed.
- The Schedule of Specifications and of payments is annexed hereto and is made part of this Agreement.
