BOND FOR QUIET ENJOYMENT GIVEN BY VENDOR TO THE PURCHASER TAKING THE PROPERTY UNDER?A DOUBTFUL TITLE

 

THIS BOND is executed on the ______ day of _______ 20______ by us _________________________ [insert the name, address etc. ofvendor] (hereinafter called ‘the Vendor’) and ___________________________________________________ [insert the name, address etc. ofpurchaser] (hereinafter called ‘the Purchaser’).

WHEREAS:

  1. By conveyance dated __________ day of _____________ is executed by and between the parties and registered with the office of the District Registrar at _________ entered in Book No. I, Vol. No. _____________ ,Being No. ______,Pages ______ to ________ for the year ________, the Vendor sold and the Purchaser purchased All That the piece and parcel of land or premises as fully described in schedule to the said Deed of Conveyance and also described in the schedule hereunder written and hereinafter referred to as “the said property”.
  2. The Vendor failed to produce the original title deed in respect of the said property for the inspection of the Purchaser and also failed to make out a good and marketable title in respect of a portion of the said property sold to the purchaser and notwithstanding the above defect in title, the purchaser agreed to purchase the said property upon the vendor agreeing to execute a bond in favour of the purchaser.
  3. It was agreed that in addition to the ordinary covenants for title implied by law in the said Deed of Conveyance, the Vendor should for the satisfaction and indemnity of the Purchaser execute the above written bond subject to the conditions hereinafter contained.
  4. By and under this Bond, the Vendor is held and firmly bound to the Purchaser or his legal heirs or assigns, in the sum of Rs. _________ (being twice the amount of the purchase money), provided further, that if the purchaser and the persons deriving title under him, shall from time to time and at all times hereafter hold, possess and enjoy the property, comprised in the said Deed of Conveyance, and every part thereof, and receive the rents and profits for the same and every part thereof, for his and their own use without any lawful interruption, claim or demand whatsoever of, from, or by any person or persons whomsoever, and free from all adverse claims, titles, interests, liens, charges whatsoever, then this Bond shall be void and otherwise the same shall remain in full force and effect.
