DEED OF RELEASE

 

THIS Deed is made at ____________on the___________ in the Christian Year Two Thousand & Ten

BETWEEN

(1)______________________,(2)______________________.and(3) _____________all of Indian Inhabitant residing a_________________________ ( herein after called

"THERE LEASORS"(which expression shall unless it be repugnant to the context or meaning thereof shall be deemed to mean and include their respective heirs, executors and administrators of the ONE PART AND (1) _______________________________(2) ______________________________and (3) ________________________________also of Bombay Indian Inhabitants residing at_____________________________________ (hereinafter called "THE RELEASEES" (which expression shall unless it be repugnant to the context or meaning thereof be deemed to mean and include their respective heirs, executors and administrators and assigns) of THE OTHER PART;

 

WHEREAS one SHRI______________________, was sufficiently seized and possessed of a property lying, being and situate at Village _________________________,and bearing City Survey No.___________________________ and bearing tika No_______________ admeasuring _____________-.sq. yds. i.e.  __________________-sq.mtrs. and more particularly described in the schedule hereunder written (hereinafter referred to as "THE SAID PROPERTY") together with structures standing thereon;

 

AND WHEREAS the said ._____________________________________ who died intestate in the year .____________________________ leaving his only legal heirs and legal representatives, viz. "THE RELEASORS" and "THE RELEASEES" herein;

 

AND WHER SHRI_______________________ and one SHRI .___________

______________________ the legal heirs expired in the year _______________ and _________________ respectively. The said SHRI.___________________________ who died intestate leaving behind his son SHRI _________________________ and others the said SHRI ___________________________ is the eldest son and is the Karta and Manger of the Hindu Undivided Family of the said deceased ______________________ who is one of "THE RELEASEES" herein;

 AND WHEREAS "THE RELEASORS" herein have agreed to release their right, title and interest;

AND WHEREAS in the events that have happened the present members of the said joint and undivided Hindu family are the parties hereto who are entitled to the said movable and immovable properties of the said joint and undivided Hindu Family.

AND WHEREAS "THE RELEASORES" have already received from "THE RELEASEES" their respective shares, right, title and interest of their joint movable and immovable properties of the said joint and undivided Hindu Family.

AND WHEREAS "THE RELEASORS" have already received from "THE RELEASEES" their respectable shares, right, title and interest of their joint movable and immovable property as stated.

AND WHEREAS "THE RELEASORS" and "THE RELEASEES" have agreed on oral partition and have already partitioned the properties and, therefore, THE RELESEES have already got their properties out of the said total properties of the said Hindu Undivided Family and "THE RELEASEES have right, title and interest in the said property got the oral partition and, therefore, at the request of "THE RELEASEES" the RELEASORS are hereinafter releasing their right, title and interest in the said property in favour of THE RELEASEES herein.

AND WHEREAS pursuant to the said oral partition the net consideration in respect of the said property is payable;

AND WHEREAS in view of the aforesaid THE RELEASORS have agreed and executed this release in favour of "THE RELEASEES" as hereinafter appearing;

NOW THIS INDENTURE WITNESSETH that in pursuance of the said Agreement and in consideration of the said oral partition, THE RELEASORS by their release in full and final settlement of their respective shares, right, title and interest and all their claims of whatsoever nature in the Estate of the said deceased SHRI __________________________________________________ the Joint and undivided Hindu Family, they THE RELEASEES jointly and each of them irrevocably relinquish their respective share, right, title and interest and all their claims and demand of the said moveable and immovable property for ever, discharge and exonerate to the RELEASEES and their Estate of the said deceased SHRI ___________________________and the said Joint Hindu Undivided Family of the said property more particularly described in the schedule hereunder written and relinquish the said right, title and interest and demise. THE RELEASORS do and each of them doth hereby covenant with the RELEASEES and each of them shall have no claim in respect of the or on account of the administration, disposition or application of the Estate of the said deceased SHRI ______________________ or any part thereof or for or in respect of or on account of any sale, loan investment and or thing made, done or executed or neglected or omitted by the RELEASORS in or about the administration, disposition or application of the Estate of the said deceased SHR___________________________ or any part thereof or for or on in respect of the respective shares, right, title and interest, claim and demand whatsoever of THE RELEASORS in, to and upon the said estate of effects of the said deceased SHRI ______________________________ or for or in respect of any other thing or in anywise releating to the said property whether or not herein expressed or referred to.

 IN WITNESS WHEREOF the RELEASORS have hereunto set and subscribed their respective hands the day and year first hereinabove written.
