INDENTURE OF TRAINING AS A QUANTITY SURVEYOR AND VALUER
THIS INDENTURE OF TRAINING made this ___ day of ____________, 20__, between __________, a company registered under the Companies Act, 2013 and having its registered office at ________________________ (hereinafter referred to as “the Company”) of the ONE PART
AND
Sh. ____________________________, s/o ____________________, r/o ________________________________ (hereinafter referred to as “the Trainee”) of the OTHER PART;
WHEREAS
- The Trainee has approached the Company to undergo training in the trade of quantity surveying and valuation and for that purpose to take him as Trainee.
- The company has agreed to take him as a Trainee on the terms and conditions hereinafter appearing.
- In consideration of the mutual covenants hereinafter contained and of the future payments by way of salary made by the Company to the Trainee, the Trainee hereby binds himself/herself as a Trainee to the Company to attend on a continuous and full-time basis at the office of the Company for a period of _________ (hereinafter referred to as "the period of in-office training") to commence on the date of execution of this deed.
NOW THIS DEED WITNESSESTH AS UNDER:
- Indentureship Period
The indentureship period shall commence from the date of this deed and shall continue for a period of ___________.
- Trainee’s Covenants
2.1 That the Trainee shall duly serve the Company during the period of in-office training.
2.2 That the Trainee shall refrain from disclosing any information as to the business of the Company, or of any client thereof, to any third party, including any information of any nature or kind received during and in the course of the period of in-office training.
2.3 That the Trainee shall promptly and efficiently carry out the reasonable directions of the Company and not be absent from the service of the Company at any time during the period of in-office training without the previous consent of the Company, and at all times during and in the course of the period of in-office training, behave with all due diligence and honesty;
2.4 That the Trainee shall take due and diligent care of all moneys and/or property of the Company or of any client thereof and not cause or permit any such moneys and/or property to be adversely handled or disposed of or damaged or destroyed or otherwise adversely dealt with.
2.5 That the Trainee shall maintain a due written record of the work done, instruction received, and experience obtained during the period of in-office training.
2.6 That the Trainee shall in the event of the breach of any of the foregoing covenants or if the Company or any member or employee or client thereof sustains or suffers any loss or prejudice arising out of the misconduct or wrongful neglect of the Trainee, make good and reimburse to the Company the amount of the value thereof.
2.7 That the Trainee shall receive a payment of Rs. _________ per month, subject to revision annually, having due regard to his contribution of the Company.
2.8 That the Trainee shall not leave the service of the Company before the expiry of the period of in-office training, and if he does, he will be liable to pay a sum of Rs. ________ to the Company as compensation for the untimely termination of the contract.
- Covenants by the Company
3.1 That the Company shall provide the Trainee with such office facilities as are appropriate and reasonable to enable the Trainee duly to work, to receive due instruction and to obtain experience in engineering.
3.2 That the Company shall instruct the Trainee or cause the Trainee to be instructed by a person of appropriate qualifications and ensure adequate arrangements for appropriate guidance of the Trainee.
3.3 That the Company shall permit the Trainee to maintain a due written record of the work done, instruction received, and experience obtained by the Trainee.
3.4 That the Company shall make suitable arrangements to monitor the progress of the Trainee on a regular basis and to discuss that progress with the Trainee.
3.5 That the Company shall pay to the Trainee a sum of Rs. ________ per month, subject to revision annually, having due regard to his contribution of the Company.
3.6 That the Company will not require the Trainee to work beyond _____ hours a day and will grant him a leave of _____ days in each of the years in the period of in-office training.
3.7 That the Company shall not dismiss the Trainee, during and in the course of the period of in-office training, in the form of any disciplinary action or otherwise, and in case the Trainee is so dismissed, the Company will be liable to pay a sum of Rs. __________ as compensation for the loss and injury caused to the Trainee thereby.
- Termination
These indentures of training may be terminated either by mutual agreement in writing between the parties hereto.
- Applicable laws
The rights and liabilities of the Trainee and the Company shall, so far as it relates to anything which is not expressly provided herein, be governed by the provisions of the Apprentice Act, 1961 and the rules and regulations framed there under.
