NOTICE TO RAILWAY FOR COMPENSATION FOR NON-DELIVERY OR SHORT DELIVERY(SECTION 78-B)

 

Notice on behalf of ____________, son of ______________., (give full address) under Section 78-B, Indian Railways Act, for compensation for loss etc__________. .to the General Manager, __________. Railway, _______
Sir,
I despatched a consignment consisting of __________. From _______ station to ________station both on ________Railway or the former being on __________Railway and the latter being on ________Railway, in my name as a consignor and consignee on __________. by means of R. R. No__________. .dated ________
The said consignment should in the ordinary course have reached the destination within __________ days but the consignment remained undelivered/or it was short delivered by __________ even after a lapse of__________ days and according to the endorsement made on the R. R. by the railway authorities at the destination the consignment is not traceable.
That the loss of the consignment or short delivery (as the case may be) is totally due to the misconduct or neglect of the railway administration and I hereby make a claim for compensation for the loss due to non-delivery or short delivery the details of which are being given below. I claim a sum of Rs __________. as the price and Rs __________. for damages.

NOTE: The Act does not prescribe any particular form of notice under Section 78-B of the Indian Railways Act. That section only requires a demand for compensation to be made. It does not require the money value of the compensation to be given. The giving of such a notice is obligatory and such a notice must be given within a period of six months of the date when the goods ought to have been delivered. Besides a notice under Section 78-B, Indian Railways Act, a notice under Section 80, CPC is also necessary to be given.
