Question :  While driving to college one morning, my friend got into an accident where a drunken tempo driver hit her two-wheeler and fell down, suffering from minor injuries. The owner of the temp, however, claims he is not responsible if the driver was drunk because he was not working that early in the morning. Whom should I claim the damages from for the damage done to the vehicle as well as the costs of minor injuries?

Answer by Kul Bhan Punia :  you may approach the motor vehicle accident claim tribunal of your area for the compensation of loss due to the accident. You have to file the claim petition against the owner driver and the insurance company of the vehicle cause accident. bills of the expenses direct expenses of medical and if there is is a grievous injury then you have to to make a disability certificate from the hospital , disability certificate is the criteria of claim you can approach the claim terminal either in which you are residing in the local jurisdiction for where the cause of action arises where the accident occurred.

Question :  I want to know, if the medical negligence complaint has gone from state commission to Supreme Court and got dismissed because of no proper merits, then can a second complaint be filed on discovery of new facts due to past medical negligence as per the fresh and continuous cause of action?

Answer by Kul Bhan Punia :  no if the case is decided by the state consumer forum on the merit basis you should not have right to complaint second time. But you may file criminal case against the doctor for medical negligence but it depends on the the time of limitation because every offence has the limitations to file the case first of all clear first of all make clear that it is within limitation.

Question :  If a gift deed is made by any member of the girls house after the death of the father and takes her sign can the deed be challenged later on ? (Under Hindu law)

Answer by Kul Bhan Punia :  Yes, According to the law free consent is necessary for every aggrement & in case of gift actual giving and receiving is mendetry. You may file a civil suit in the civil court of proper jurisdiction.
