Answer by Sharada H V :  Dear ravi You will have to send a legal notice to the company to return back the deposit amount. For issuing legal noitce you will have to provie few information as to your agreement with the car rental company and if at all the company is withholding the amount on the basis of any dues or deductions under the terms of agreement. Question :  divorce after getting decree of judicial separation

Answer by Sharada H V :  If you have apready taken a judicial separation from the court order and if there is no marital relationship even after that for a period of one year between husband and wife, if you have come to the conclusion that both of you cannot lead the life further you can apply for the divorce.

Question :  How can a mortgage property to be registered in the name of the lender.

Answer by Sharada H V :  you have to execute a regd. mortgage deed and thereby you register the property in the nameof the lender.

Subject :  Can I file a case if some one has captured my house for more than 20 years

Question :  My grandpa sold one house and died but the party captured another house and merged it together we were not aware of that so can I file a case for more than 20 years

Answer by Sharada H V :  You can file a case for eviction by saying that they have encorached your property illegally. But why no action is taken for past 20yrs. This question will arise for which you need to give strong reason which is acceptable by court

Subject :  From whom should the damages be claimed after an accident?

Question :  While driving to college one morning, my friend got into an accident where a drunken tempo driver hit her two-wheeler and fell down, suffering from minor injuries. The owner of the temp, however, claims he is not responsible if the driver was drunk because he was not working that early in the morning. Whom should I claim the damages from for the damage done to the vehicle as well as the costs of minor injuries?

Answer by Sharada H V :  You should have given police compliant about this. So u could have filed a compensation case ahainst the owner &driver of vehicle who committed accident

Question :  Mother dies after signing unregistered MoU of family settlement among her adult living children. Question is does the MoU in question have any legal binding on signatories of the MoU?

Answer by Sharada H V :  If all the family members agree for the same settlement terms. You can make a new MOU for settlement and register the same. As Mother has expired you cant register this document though it is signed by all.

Question :  A property comes under waqf was given to a family on lease for 99 years before 60 years ago and that contains religious mazars and now I want to break the lease so that I can use it for public welfare and to give that place to poor family on their daughters marriage can I break the lease if waqf makes me a care taker.

Answer by Sharada H V :  No U cant give the wakf property for an individual's personal benefit. moreover you are holding the property on lease basis only and you can never be the owner of land/property for which you will not have absolute right, title & interest. Even if you are the caretaker of property you are taking care of it you will never have absolute right to sell or give it to anyone.
