Bombay High Court's dismissed PIL filed by one Satish Gaikwad seeking stay on release of biopic based on Prime Minister Narendra Modi, the petitioner has now moved the Supreme Court seeking leave to appeal against the said order of dismissal. Gaikwad is the national president of the Republican Party of India (I). On April 1, 2019, the high court refused to stay the release of the film and observed that since the Election Commission had already taken cognizance and issued notice to the filmmakers, there was no need to interfere.
The ECI had submitted before the Bombay High Court that there was no violation of the model code of conduct for the election.
The Supreme Court on Thursday agreed to urgently hear the petition demanding a stay on the release of a biopic on Prime Minister Narendra Modi, being a blatant propaganda with little or no artistic inspiration and only meant to manipulate voters in violation of Model Code of Conduct in place for Lok Sabha polls of 2019. The court said it will hear the petition, filed by a Congress leader, on April 8.
The film PM Narendra Modi was scheduled for release on April 5, but has reportedly been postponed to April 12, which was the original release date. Congress leader Abhishek Manu Singhvi, appearing for petitioner another Congress leader AmanPanwar said the film’s release may affect free and fair elections.High Courts in Bombay, Delhi and Madhya Pradesh have already rejected petitions demanding a stay on the release of the film. The courts said they would not intervene in the matter as the Election Commission had take cognisance of the film.The SLP demands an immediate stay on the release as an ad interim relief to the petitioners. The petition mentions that high court has not taken all the aspects of the petition into consideration before rejecting the plea.
The Central Board of Film Certification (CBFC) told the court, through its lawyer AdvaitSethna, that it had already granted requisite certificates for the trailer on March 20.
The film depicts the journey of Modi from his humble beginnings to his years as a chief minister and finally his landmark election as the Prime Minister. Vivek Oberoi is essaying the role of Modi.
