The Kerala High Court was dissatisfied regarding the enquire report about the torture of Tittu Jerome. The report was submitted by DIG prison. The prisoner in question was a convict serving a life term in the Kevin Murder case. The bench comprising of Justice K Vinod Chandran and MR Anitha stated that they were unhappy with the way DIG has submitted the report, which has been authorized by DGP.
The bench also expressed that there was a prima facie attempt in the report to protect the prison personnel who were involved in the torture. The bench had made such observations in a habeas corpus petition filed by the parents of Jerome who stated that he was being subjected to torture in the prison. When the petition was being first considered by the bench, the bench directed the Additional District Judge and District Medical Officer to enquire about the conditions of the Jerome by visiting the prisoner. The Additional District Judge submitted a report saying that there were indications of torture and he had been shifted to the hospital for suspected renal injury. The bench then ordered the DGP to probe into the incident.
The report attempted to discredit the complaint and termed it as a retaliation measure. They said that this was a measure taken against the disciplinary action taken by police against him for smuggling in liquor. The report stated that this enquire was made against 4 prisoners who were accused of smuggling liquor into the prison.
The bench expressed that this report was contrary to the report submitted by the ADJ. They also noted of the absence of the mention of injuries stated in the previous report. The court directed the DGP, Prison to conduct another enquiry and submit within two weeks. The court further directed jurisdictional Judicial Magistrate to record the statement of Tittu Jerome.
