On Wednesday, 13th January 2021, Justice Pratibha M Singh of Delhi judicature issued a notice in a plea filed by the Society for Alternate Fuel and Environment (SAFE). The plea was filed due to the non-implementation of the rules for Scrapping of motorcars in Delhi, 2018 given out by the Delhi Government. The plea states that the govt. of Delhi and therefore the Delhi Transport Corporation together with MSTC Ltd., at the time of accepting tenders for disposing of end of life vehicle is not adhering to the rules issued by the Delhi government’s Department of transport.
The guidelines mention, only a sanctioned scrapper has the authority to participate within the process of the scrapping of those end-of-life vehicles. Nonetheless, the petitioners have accused MSCT Ltd. of accepting auctions from non-authorized scrappers who illegally partake within the scrapping process which entirely violates the rules of the govt. The ultimate motive of the rule has been put to sleep a dilemma because the aforementioned acts are degrading the environment in step with the plea.
The Single Judge Bench has also issued notices to the Ministry of Transport, Union of India, Delhi Transport Corporation, the govt. of NCT of Delhi and MSTC ltd. The bench also did clarify that future auctions that might be conducted by MSTC Ltd. shall be subject to the result of the petition. The order also said, “GNCTD shall specifically confirm in its counter-affidavit that it's strictly adhering to the rules for the needs of the scrapping of a motor vehicle”. On 24th August, the transport department of the Delhi Government placed on the rules for the Scrapping of automobiles in Delhi, as per the directions provided by the National Green Tribunal so as to counter the degrading air quality of the capital city.
The reason behind the implementation of those rules was to get rid of junk vehicles found abandoned on the streets in an environment-friendly manner.
The matter would be heard on 14 April 2021.
