On Friday, the Visva Bharati University was issued a show-cause notice by the Calcutta High Court for not complying with its orders in a case relating to the payment of salary to a Professor. The notice was issued by a division bench of Justices Saugata Bhattacharyya and Soumen Sen.
Last year in December, the division bench of the High Court noted that in the dance drama created by Tagore, Manipuri Dance has an integral part.
The university had submitted that the petitioner was only entitled to Rs. 2,30,958 as salary but she had been receiving more. Prima facie, the court observed that a person cannot be directed to return any amount of their salary after she has worked on a post and performed her duties. Due to the conflict, the court ordered that the university should pay the amount it claimed to be payable to the professor and deposit the remaining amount of the actual paid sum in a separate bank account.
The instructed that the account should be opened in the name of the university in any nationalized bank. The differential amount has to be deposited in the said account till the Writ petition has been disposed of by the court. The court’s order was given on 24th December 2021.
However, on Friday the court was informed by the petitioner that the University had not complied with the above order. It was further brought to the bench’s notice that the University had not filed the affidavit of compliance.
The court has thus ordered that Ashok Kumar Mahato, Registrar of the Visva Bharati University be personally present on the next date of hearing along with the affidavit giving reasons as to the non-compliance of the orders.
The matter has been listed for 4th February 2021.
