Sonu Sood, an actor, had filed an appeal in the Bombay High Court, earlier this year, on 6th January, against the trial court's verdict on an Interim Application (IA) filed by him against a notice sent to him by Brihanmumbai Municipal Corporation (BMC).
In the Interim Application, the actor has requested the court to grant a stay order on the notice sent to him by the BMC which alleges that the actor has made certain additions and modifications, to his residential property at Juhu, beyond what had been approved by the BMC in an unauthorized manner. The City Civil Court at Dindoshi had rejected the actor's Interim Application citing that the actor has actually made illegal modifications to his property.
Advocate Amogh Singh, the legal counsel for Sonu Sood, contended that the notice sent by BMC was not clear regarding what they considered to be an unauthorized modification to the property and that this ambiguity made the notice invalid. The legal counsel for BMC, Senior Advocate AY Sakhare, argued that the petitioner had not approached the Court with a good intention. He further elaborated that the actor has suppressed material facts of the case from the Court.
He further elucidated that the unauthorized modifications, in question in front of the Court, have already been declared illegal by the BMC twice and have been demolished and reconstructed after each notice. He continued saying that the actor had not contested the previous notices in front of any court. He argued that because the speaking order on the notice sent by the BMC, directing the actor to demolish the unauthorized modification in case he fails to present necessary documents, was never challenged, it is still valid and hence the order for demolition still stands.
Justice PK Chavan, of the Bombay High Court, has heard the legal counsels of both the parties and then issued his daily order. The Court has issued the daily order that it has reserved its verdict until the next hearing.
