The bench of Chief Justice of Madras High Court Sanjib Banerjee and Justice Senthilkumar Ramamoorthy ordered the government of Tamil Nadu on February 8th to file its counter affidavit within 6 weeks in response to a writ petition filed regarding the cruel methods employed in the transportation of animals being taken to slaughterhouses.
The petition regarding the issue of illegal transportation of animals in Tamil Nadu particularly from one district to another was filed by V.S.K. Tamilselvan of Erode. He alleged that although several rules and regulations have been enacted to protect the rights of animals, especially cows that are taken to slaughterhouses, the rules are never followed. He stated that the way animals are taken to be slaughterhouses violated the provisions of the Prevention of Cruelty to Animals Act of 1960.
The court observed that the plea drew its attention not only towards the plight of cattle but other animals that are slaughtered for human consumption as well. Therefore, the state government was directed to file the counter affidavit not only regarding cattle but animals lamb, goat, and sheep as well. Chicken, which is currently the most common source of animal protein shall also be covered. The bench demanded guidelines to be laid out to ensure ethical treatment for animals even if they are raised to be slaughtered in the future.
Legislations on Animal Rights in India
It was the first law that was passed in India for the welfare of animals. However, it does not cover animals used for scientific experiments and human consumption.
This law was implemented to outline the provisions for breeding animals and their use for research purposes. It was amended in 2006 to allow experiments only on animals that are considered to be on the bottom of the genetic scale that too only when a non-animal alternative is not available. The law was again amended in 2013 to prohibit the use of live animals in medical schools for experiments.
