The Rajasthan High Court on Monday, 15th February granted the Bollywood producer cum filmmaker Prakash Jha protection against coercive actions with respect to an FIR filed against him for offenses u/s 3(1)(R)(S)(U) of SC/ST Act.
The Jodhpur Bench of Justice Manoj Kumar Garg has given safety to the producer Jha till the next hearing of his plea to demolish the FIR lodged against him in Jodhpur.
This FIR has been filed against the producer for allegedly hurting Dalit sentiments and beliefs in his web series "Aashram" by the objectionable depiction of the community.
The FIR, lodged in the register was noted- FIR No.06/2021, PS Luni, District of Jodhpur City West.
As stated by PTI, this FIR was booked on a complaint filed registering that in a specific scene of the 1st episode in the web series 'Aashram', the upper caste people are seen insulting a Dalit community bridegroom.
The complainant while lodging an FIR had said that such an indecent scene has not only humiliated and insulted the Dalit community but on the other hand has sought to encourage abusive and harmful behavior of the upper caste people.
The producer-filmmaker in response to this moved the Rajasthan HC seeking the court's order, dismissing the FIR.
It was argued before the Division Bench that the police should not have involved the Sections 3(1)(R)(S)(U) of the SC/ST Act against Prakash as it was mentioned, it was not a real case of harming the sentiments of anyone neither insulting anyone but it considered only the portrayal of a fictional situation in the Web Series, 'Aashram'.
The High Court has also issued notices to the State along with the complainant seeking their response on Prakash's plea within six weeks of time.
