The bench of Justice Suresh Kumar Kait issued notice to Congress Chief Sonia Gandhi and her son Rahul Gandhi asking them to respond to a plea submitted by Rajya Sabha MP of BJP Subramanian Swamy seeking to lead additional evidence before the trial court (Special Court in Rouse Avenue Court Complex, New Delhi) in the National Herald case. The Delhi High Court also issued notices to Sam Pitroda, Oscar Fernandes, Suman Dubey, and Young India Pvt Ltd (YI) who are involved in the corruption case.
Subramanian Swamy had moved to the high court of Delhi after the trial court rejected his plea to lead evidence to prosecute the mother and son duo. The trial court had stated that it would issue such notice after the examination of the case was over. He had accused the Gandhis and others of misappropriating funds and conspiring to cheat by paying 50 lakh rupees through which Young India obtained to recover the amount of 90.25 crore rupees that A.J.L (Associate Journals Ltd, owner of National Herald) owed to the Indian National Congress.
He has sought the summoning of several witnesses such as the secretary-general of the Supreme Court (Registry Office), a deputy income tax commissioner, and a deputy land and development officer.
Advocate Satya Sabharwal, who represents Subramanian Swamy, and Advocate Tarannum Cheema who represents the Gandhis, and others confirmed that the high court has stayed the trial court proceedings until April 12, 2021.
About the Case
National Herald Corruption Case is an ongoing case that was filed by Subramanian Swamy against Sonia Gandhi, Rahul Gandhi, and associated companies and people. He alleged that they had engaged in fraud and land grabbing worth 220 million USD by acquiring a company called A.J.L. through Young India, which is their own privately-owned company. he had further alleged that the real estate properties that the company acquired were given by the government for the sole purpose of publishing newspapers, but were being used to run a passport office with a rental income in millions of rupees.
