The Bihar Government recently submitted to the Patna High Court that it will create a separate unit for people who belong to the transgender community in the state police force that will be called Special Unit (Transgender) at the district level under the Superintendent of Police of the district. According to the state government, it is a sincere attempt to give 'respectful representation' in public employment to transgender people in order to include them in the mainstream of society and also boost their morale. This step would also help to change the perception that society holds towards transgenders. The affidavit was filed by Amir Subhani, Additional Chief Secretary, Government of Bihar and submitted before the bench of Chief Justice Sanjay Karol and Justice S. Kumar.
The Chief Secretary stated that it was not possible for the state to create a separate battalion for the transgender community since transgenders constitute only 0.039% of the total population of Bihar. Therefore, the government of Bihar decided to create a special police unit that would employ only transgender people at the district level.

The Patna High Court had asked the Government of Bihar to allow people of the transgender community to apply for the post of constable. Moreover, this year in January, the government of Bihar had informed the High Court of the state that it would be providing transgender people reservation in appointment to the post of constable and sub-inspector.
The Aurangabad bench of the Bombay High Court allowed a transgender person to contest in the village panchayat elections as a woman candidate. The bench observed that according to the Transgender Persons (Protection of Rights) Act of 2019, transgenders have the right to identify their self-perceived gender identity.
The centre recently had informed the High Court of Delhi that transgenders will be considered as a separate gender category in Prison Statistics Report that is prepared by the NCRB (National Crime Records Bureau).
