The Bombay High Court has sought the records and proceedings relating to the sedition case of Kangana Ranaut from the Metropolitan Magistrate court. A complaint was filed against Kangana and her sister Rangoli Chandel for spreading hatred through their tweets. Advocate Rizwan Siddique had appeared on behalf of Kangana Ranaut. Siddique stated that actions were not initiated accordingly under Section 154(1) and 154(3) of the Criminal Procedure Code by complainant Munnawarili Sayyed and, so the lower court didn’t accept the complaint though the complaint was contemplated by the court previously.
According to Section 154(1), any information which is related to a cognizable offense must be reported to the nearby police station. And, if the police do not lodge the complaint under Section 154(3), then such information must be reported to the Superintendent of the Police. Siddique made submissions by stating that the facts mentioned in the complaint are false. Advocate Rizwan Merchant had appeared on behalf of Sayyed and stated that the letters were submitted accordingly with Section 154(1) and Section 154(3) of the Criminal Procedure Code. He had presented the records and proceedings before the lower court which was provided under the Right to Information Act.
While considering the submissions made by Siddique, Justice Pitale Merchant has sought a response from Merchant on these submissions. Justice Pitale said that the magistrate should have checked the compliance. He also opined that the Magistrate must see that there was no compliance under Section 154(3) of the Criminal Procedure Code. Merchant had urged the Court to provide the previous records and proceedings of the lower court. But Justice Pitale stated that it would not make any difference in the case as the submissions are already submitted. Still, the court has passed an order to provide the recordings and proceedings of the lower court. The court has ordered that the papers must be provided by March 12 and also decided to hear the matter on March 22. Bollywood Actress Kangana Ranaut and her sister Rangoli Chandel have already agreed to cooperate in the investigation and also in interrogation whenever they are called to the police station. It was also noted by the court that the State would not take any action against them. Both of the sisters were given interim protection till March 22.
