The supreme court on Monday asked a 23 years old man, who stands accused of raping a minor girl when she was aged around 16 years, whether he will merry him, In a shocking case where a minor was sexually assaulted for almost years by a man who is a government servant in Maharashtra State Electricity Production Company ltd., The Supreme court bench headed by the Chief Justice SA Bobde granted protection from which has cancelled the anticipatory bail granted to him in the case.
The Supreme Court initially asked the lawyer for the man whether he would agree to marry the girl, who is now 18 years old.
The bench also comprising justice As Bopanna and V Ramasubramnian, asked the accused “will you to marry her?”
“If you are willing to marry her then we can consider it, otherwise you will go to jail,” observed the bench adding “we are not forcing you to marry”, S.C. initially asked the Advocate Anand Dilip Landge informed the court that the man has “Offered to marry the girl but has refused”
The girl made that the statement “I am not positioned to marry her because I am already married and it is not possible, According to the F.I.R. when the girls in 9th standard and the accused stopped her from going to school and one day he forcibly entered in his home and voluntarily raped her. in her complaints the girls has also disclosed that the accused was also threatening to throw acid on her and kill her brother if she did not consent to have sex with him.
When her family found out about the relationship, the accused's mother offered to get the marriage done once the girls attained the majority age.
According to the allegation, once the girl turned 18, the accused refused to marry her
The man has been granted anticipatory bail from the trial court which was then cancelled by the Aurangabad bench of Bombay high court. The high court on his judgement said that cancelling the bail granted to the man has observed that granting bail to the man was ‘atrocious’.
