A petition was raised by Justice Gautam Patel of Bombay HC, on 17th February, Wednesday regarding the issue of overpopulation in his courtroom. In reply, the court warned it would be suspending physical hearings if the norms and regulations aren't followed properly by all and would be going back to virtual hearings.
The High Court of Bombay resumed conducting physical hearings on December 1 of 2020, while subordinate courts resumed the physical hearings on February 1st of 2021 with full capacity.
Justice Gautham Patel has segregated the cases he will be hearing in batches, and also mentioned each batch a specific time slot when the case will be heard. The notice stated that all the advocates and lawyers should adhere to their time slots mentioned. "
This is on the subset of the covid-19 induced pandemic and the spreading of the virus rapidly.
The judge further mentioned that if the lawyers and advocates and parties refuse to follow these simple instructions, the court would be subjected to go back to the virtual model of hearing.
"If these simple and minimum precautionary norms are not followed, the Court will be immediately suspending all the physical hearings and revert to virtual hearings in all subject matters".
The High Court had dismissed the conduct of physical hearings in the month of April first week, 2020, and began conducting online/virtual hearings through video-conferencing for urgent matters in light of the covid-19 pandemic.
The High court subsequently began a combination of online and physical hearings, and in the month of December 2020, most of the cases pending and are yet to be heard. Currently, all the benches in the high court complex function in full capacity hearing all cases via physical hearings being conducted from Monday to Thursday.
On Friday, some courts conduct online hearings through video-conferencing for cases where the advocates or parties are not based in Bombay, or if the lawyers specifically request for conducting virtual hearings.
