Varavara Roy, The 81-year-old poet-activist who has been in jail for over 2 years in the Koregaon Bhima case, was granted bail for six months by the Bombay high court on medical grounds. Senior advocate Indira Jaising, represented Rao argued that the crime which Rao is accused of is not a serious one. Indira Jaising also cited the case of Kanchan Nanaware, A student rights activist accused under the unlawful Activates (prevention) Act. Jaising also said that the Nanaware died in the prison after six years of incarceration before her trial could begin and her medical bail was decided.
He is currently undergoing treatment at Mumbai’s Nanavati hospital where the Rao was admitted by the Maharashtra government following the high court intervention.], he has been in custody since August 28, 2018, awaiting trial in the case.
Rao’s wife, Pendyala Hemalatha has also petitioned the court for a declaration that her husband's fundamental rights to Health, Dignity, and life, and thereby have rights, Under Article 21 of the Constitution of India have been violated by Taloja Prison officials, as they neglect to give him the timely treatment required.
That high court today said if it did not grant medical bail, it would be abdicating its duty to protect the principle of human rights and a citizen’s fundamental rights of life and health.
“We are relieved. It is a big relief to us. Because for the last 2.5 years, no one was getting even a small relief in the case. This is the first relief in the Bhima Koregaon case. We are happy but the condition is there that we have to be in Mumbai. We have to think about it and plan. We will talk to the Lawyers" Mr. Rao's daughter Pavani said.
During the previous hearing, The Court observed that Rao’s Catheter remained unchanged for three months in the hospital ward of Taloja Hospital.
