The High Court of Kerala has envisaged and recommended the government to implement a new formula to give compensation to those affected by floods in Kerala. The High Court had passed the order while hearing a PIL to establish special tribunals to evaluate the compensation and distribution to the victims of flood.
The petitioner had noted that there must be a firm basis in which the compensation is granted and a uniform formula to realise the same. The court has brought out a two tier formula in which minimum compensation can be granted in the first stage and then the compensation for actual loss can be given in the second stage. The court said that the compensation would be granted on the basis of the actual loss suffered and not on the basis of income. This would prevent the hassle of extracting various certificates to support the claims.
The court had earlier asked the government to submit a statement regarding the procedure opted by them to distribute compensation vide order dated August 16, 2018. The High Court praised the policy but said that a unique formula has to be developed to distribute compensation.
