What is Continuing Mandamus?

Continuing mandamus, also referred to as mandamus in perpetuity, is a judicial remedy designed to address situations where the enforcement of a single mandamus order is insufficient to secure full compliance with the court's directions. It empowers the court to monitor the progress of a matter and issue further orders as necessary until the desired objective is achieved.

Unlike traditional mandamus, which is concerned with the performance of a specific act or duty, continuing mandamus is concerned with the ongoing supervision and enforcement of the initial mandamus order. It allows the court to retain jurisdiction over the matter and take necessary measures to ensure compliance until the purpose of the original order is fully accomplished.

Purpose and Scope of Continuing Mandamus:

The purpose of continuing mandamus is to provide a more effective mechanism for the judiciary to enforce its orders and secure the rights of individuals or groups. It is typically invoked in cases where the court has issued directions or guidelines to address systemic issues, violations of fundamental rights, environmental concerns, or matters of public interest.
